In Texas, the boy would probably be dead. Most people that heard noises in the house at 3 AM would have investigated with a gun in hand. The boy is most fortunate.
The boy's father should share some of the blame in this case. Why is the boy out and about at this time of the morning? It is hard for me to believe that the girl's father had no idea of what was going on since the time period is 18 months. The girl would have been 13 1/2 years old when it started and I believe it would be hard to ignore a daughter for that long.
Regardless, everyone involved is at fault to some degree and all will have to answer to a higher authority than the local law. A lot of teaching, praying, admonishing, and love needs to transpire before this "mess" is ever straightened out.
